Brian Cummings
Medical Malpractice Attorney at Law

Brian Cummings has 20+ years of litigation experience successfully handling and trying medical malpractice, personal injury, and car accident cases. He has obtained over $29,000,000.00 for his clients in just the past few years, which earned him a lifetime membership in the Multi-Million Dollar Advocates Forum. He has vast experience analyzing claims and facts to gain judgments and settlements for his clients. Brian enables his clients to focus on their daily lives by entrusting the litigation process to him. He only takes on select cases so that he can personally handle every aspect of that client’s important case.

Brian is Board-certified as a Medical Malpractice attorney by the American Board of Professional Liability Attorneys. He is 1 of only 2 attorneys in Hawaii who have earned this certification. Board-certification is awarded only after having your trial experience vetted and passing an extensive written exam.

He has been selected by SuperLawyers for 7 consecutive years as a plaintiffs’ attorney handling medical malpractice and personal injury cases (2015-2021).

Brian has the highest rating available for attorneys from MartindaleHubbell, having been designated as AV Preeminent. The AV rating means a lawyer’s peers (attorneys/judges) rank him at the highest level of professional excellence. He also has the highest rating possible with Avvo-a 10.0 / Superb rating.

Brian is a Senior Fellow of The Litigation Counsel of America (LCA). The LCA is a trial lawyer honorary society composed of less than 1% of American lawyers. Selection is based on effectiveness and accomplishment in litigation, as well as ethical reputation. Brian is 1 of less than 10 attorneys in Nashville who are Senior Fellows.

He is admitted to practice before the United States Supreme Court, the U.S. District Court in Hawaii, and he is licensed to practice in Hawaii, California, Tennessee, Georgia, and Florida.

Brian has multiple jury trial successes, including a $1,100,000.00 jury verdict as recently as December 2018 in case in which the defence made no settlement offer prior to trial, and he has obtained strong settlements for his clients in a variety of other medical malpractice cases. He makes a point to develop themes and exhibits to share with juries to complement the concise, jury-friendly, and story-telling style he uses at trial. Brian speaks frequently at medical malpractice seminars by invitation, with the most common request being that he share with other lawyers his insight and experience regarding how to prepare and present the best arguments and stories to persuade juries.
